The Spanish Agency for Data Protection complains to the Government: its collaboration in the contact tracking app was late
Yesterday the Government of Spain announced the launch of a pilot project in La Gomera to evaluate for two weeks the operation of the COVID-19 notification exposure and contact tracking application.
In that announcement, the Secretary of State for Digitization and Artificial Intelligence (Sedia) indicated that the Spanish Data Protection Agency (AEPD) had collaborated in the project, but in a singular statement this agency reveals how Sedia did not have it from the principle: his participation started late and badly.
Discrepancies between Sedia and the AEPD
In the official announcement of the Sedia it was clearly indicated how "The Spanish Agency for Data Protection has participated in the process prior to the launch of this pilot", but after that announcement a statement from the AEPD itself denied such information:
"The Agency's involvement in the contact tracking app developed by the Secretary of State for Digitization and Artificial Intelligence has had to limit itself to starting on May 21 a procedure of preliminary investigation actions that has not yet been completed"
The procedure was opened "immediately after the public announcement of the project", and in the APED they complain about "ignorance of the details of the practical articulation of the application", something that was important in order to analyze the "incidence on the privacy of citizens. "
This situation has caused the Sedia to request more information from the Sedia, but all this apparently with less integration of the AEPD in the process than the official announcement of the Government of Spain seemed to point to.
The statement concludes indicating that they will try to improve the data processing in the final stages of its development, but make it clear that the person responsible for that treatment (Sedia) is the one who "must take into account data protection from the start of the design of the project".
